WOFT reserves to active duty

BLUF: I am looking to post my situation here and get some feedback on possible next steps.

 

In 2016 I was selected for the WOFT program and went to WOCS in October of the same year. I was third in my class and was sent home to my reserve unit to await the start of flight school. My first BA home I was arrested on suspicion of DUI. A SIR was sent up the chain of command and I recieved a locally filed GOMOR. My case went to court and was dismissed with no presumption of guilt due to the breathalyzer not being admitted as evidence as a result of procedure meant to ensure accuracy not being followed. After the disposition was sent to my command I was informed by my battalion commander that I would not be separated and would not have my appointment voided. However, in the GOMOR I was told I would not be sent to flight school with that unit. My BC has told me he thinks the best option is to drop a packet for the active duty component. It's a convoluted situation and I appreciate any feedback.

 

Side note: I was not intoxicated at any point throughout this arrest. That said, I do understand and take responsibility for allowing myself to be in a situation where alcohol could have any impact on my life and career. Drinking and driving is not illegal (being under a .08) but it is not smart. This has been a lesson learned for me and I believe it has made me a better soldier and officer. I have the full support of my unit.

Yea my money is on you losing that appointment to Warrant. There is a nice piece of paper you signed saying that you must complete WOBC(aka flight school) within two years of being appointed. And the clock is ticking. Might be their way of pushing you out, without pushing you out.

 

As far as AD, my interpretation is that you must already be a rated aviator in order to do CAD.

BLUF: Not only do I think the odds of you slipping through the system unnoticed is slim, the fact that you have to work it in a way that hides the truth, should throw up red flags for YOU.

 

My opinion: There's no chance you'll be able to sneak back in flight school without someone noticing. Imagine you apply for AD, maybe HRC catches it immediately, realizes you've already been selected and denies your packet. Or maybe you get selected, and HRC goes to slot you for WOCS because, you know, you just got selected and all. You can say to HRC, "Hey, I already did that," or maybe they give you a slot for WOCS, and you say "I'll just do it again, oh well." Sooner or later like stocktrader said, you lose your appointment from the reserves side. I know it's convoluted and crazier things probably have happened, I just highly doubt that it goes unnoticed.

 

I think your best bet is facing this as head on as possible; if it's filed locally, then can you transfer to a different reserve unit? (I'm not sure how that works, maybe someone can shed some light on that)

Just as a PSA for others that might read this. In regard to drinking and driving not being illegal under a .08, that's not entirely true. The .08 is the minimum in which they can charge you for DUI based on the breathalyzer test, .08 is not the maximum you can have without being charged with a DUI.

 

An officer has the option to charge someone that is under the .08 with a DUI if they are unable to pass a Field Sobriety Test, happens all the time. You can blow a .05 and still be charged if the officer determines you are impaired.

 

So the bottom line is that you at risk every time you drive after drinking, not everyone reacts to alcohol the same, some can drink two beers and be impaired but not over a .08, some can handle it better. Best bet is to take an Uber or have a designated driver if you plan on drinking more then one drink in an hour.

 

To have the mindset that you can drink enough to be just under the .08 limit and not be charged with a DUI is a big mistake.
