The idea of using the military to police the American people without Congressional authorization was long held as unconstitutional under the Posse Comitatus Act of 1878. We now have the National Defense Authorization Act for Fiscal Year 2012. This is far from business as usual. This escalation of military presence and the final dismantling of Posse Comitatus began with Bush’s signing of NDAA 2007. The last nail was place into the Posse Comitatus Act with Obama’s signing of NDAA 2012. A September 2008 article in the Army Times was first to make clear plans for increased military presence here at home. “3rd Infantry’s 1st BCT trains for a new dwell-time mission. Helping ‘people at home’ may become a permanent part of the active Army. Sept 2008” “Beginning Oct. 1 (2008) for 12 months, the 1st BCT will be under the day-to-day control of U.S. Army North, the Army service component of Northern Command, as an on-call federal response force for natural or manmade emergencies and disasters, including terrorist attacks. “It is not the first time an active-duty unit has been tapped to help at home.
