DirtyCrewChief Posted February 7, 2014 Posted February 7, 2014 I'll be up front and honest. I have two things on my record from years ago that I can't seem to get a solid answer on. I have Minor in Possession of Tobacco, and Disturbing the Peace (friend had PA system in his truck). I have waivers typed out but the fines (excluding court fees) were $25.00 for the MIP charge and $75.00 for the DTP charge. I have been told that if the fines were not over $250 I wouldn't need a waiver. Anyone able to shed some light on this? Will I need waivers or not? On top of that I read if you have less than four minor offenses you won't need a waiver. Thanks Quote
Yamer Posted February 7, 2014 Posted February 7, 2014 Pretty sure no waiver needed. I'm not the end all be all decision maker though Quote
lee122485 Posted February 7, 2014 Posted February 7, 2014 Can you answer yes to this: HAVE YOU EVER UNDER EITHER MILITARY OR CIVILIAN LAW BEEN INDICTED OR SUMMONED IN TO COURT AS A DEFENDANT IN A CRIMINAL PROCEEDING (Including any proceedings involving juvenile offenses, article 15, UCMJ, and any court-martial) REGARDLESS OF THE RESULT OF TRIAL, OR CONVICTED, FINED, IMPRISONED, PLACED ON PROBATION, PAROLED OR PARDONED, OR HAVE YOU EVER BEEN ORDERED TO DEPOSIT BAIL OR COLLATERAL FOR THE VIOLATION OF ANY LAW, POLICE REGULATION OR ORDINANCE? (Exclude traffic violations involving a fine or forfeiture of $100 or less) Another thing, are you AD or civilian? It looks like your fines are good so you don't have to worry about that resulting in a submission of a moral waiver. The big question is, did you ever have to go to court for the infractions you mentioned? In the end, those look like minor charges. They're going to look at the charge, the outcome, how long ago it happened, what you did to change yourself, etc... I think you're good, but it varies for each person. I had a moral waiver for a more serious matter and my waiver was approved. So again, based on personal experience, I think you have a good shot. Quote
lee122485 Posted February 7, 2014 Posted February 7, 2014 Sorry I overlooked you saying excluding court fees, obviously meaning youDID go to court. With that said, you were summoned to court as a defendant in a criminal proceeding.... At least that what it looks like, meaning a moral waiver is needed. Quote
DirtyCrewChief Posted February 7, 2014 Author Posted February 7, 2014 Yes I'm active duty. I don't know why I didn't need to get waivers to enlist. It never came up. I appreciate the help! Quote
Yamer Posted February 7, 2014 Posted February 7, 2014 No clearance for your mos to enlist??? Based on you being a crew chief Quote
lee122485 Posted February 7, 2014 Posted February 7, 2014 Hm, if you didn't need waivers to enlist you might not need them for WO. Definitely something to look into further. Quote

nskojo Posted February 7, 2014 Posted February 7, 2014 In most cases your juvenile records are sealed, if you did not disclose this information with your recruiter when you enlisted I think your good. If this happened when you were an adult I would think you need a moral waiver as anyone can find this information Quote
